Signatures (in letters of authorization or commitment, Powers of Attorney, etc.)

In case an applicant (i. e. signatory of a document) wishes to certify his/her signature on a particular document -such as on a letter of authorization or commitment or a Power of Attorney, for example- at a Notary Public in Malaysia instead of at our Consular Section directly, then the following procedure must be followed:

1. Commercial documents

1.1 The company of the applicant ("submitting company") must be registered at our Embassy. Please check the registration procedure here.

1.2 Only original documents will be endorsed.

1.3 In case documents are not written into Spanish, an official translation into Spanish for reference must be provided. The translation into Spanish could also be included into the same document (i.e: a side by side translation, line by line translation or original text above and translation below).

1.4 The signatory must be a representative of the company who holds the position of Director or above as registered on Form 49 from the Suruhanjaya Syarikat Malaysia (SSM) and he/she must sign every page of the document (include signature + print name + ID/Passport number on every page). Alternatively, the signatory could be any other representative of the company who has been duly authorized as specified in the company registration procedure (please see "1. Request letter").

1.5 The Notary Public who certifies the signature of the applicant must stamp his/her stamp and signature on every page of the document as well. At the front of the document, the Notary Public must add a Notarial Certicate (just for a general reference, check a sample here) (*) stating that the signatory has personally appeared before the Notary and signed the document in his/her presence and including, at least, the following information: a) type and date of the document (e.g "Letter of Authorization dated January 1, 2021") (**); b) full name, ID or passport number and position of the signatory at the company; c) confirmation that the signatory has been confered with all necessary power and authority by his/her company to sign such document. Behind the Notarial Certificate, the Notary Public must include, sign and stamp a copy of the ID or passport that the signatory used to identify him/herself before the Notary Public.

(*) There must be one (1) Notarial Certificate per document. If a Notarial Certificate legalizes more than one (1) document, then it will be rejected and not legalized by our Embassy.

(**) The date of the document must be the date when the document is signed and notarized.

Please inform to us beforehand which Notary you expect to hire for the said purpose as some specific Notaries are not accepted by this Embassy.

1.6 After the Notarial certification, the documents must be endorsed by the Ministry of Foreign Affairs (MOFA) of Malaysia according to the following guidelines: a) at the Notarial Certificate there must be the date of endorsement, stamp and full signature of the MOFA official who endorses the document; b) the rest of the pages must include, at least, the date of legalization by the MOFA and its stamp; c) each set of document must be legalized by the same MOFA official (i. e. a Notarial Certificate legalized by one MOFA official and the rest of the document legalized by another MOFA official will not be accepted).

1.7 The documents must be submited to our Embassy together with a cover letter (please refer to point 3.4 here).

1.8 The designated person who is bringing the documents must present his/her original IC or Passport upon submission, as well as a photocopy of it.

1.10 Fees and payment: US$ 200 per document (to be paid in ringgits by online transfer). Upon submission, the Embassy will issue a receipt for payment to be made by online transfer to our associated bank. The transfer slip must be sent to the Embassy in order for us to process the documents. Kindly note that no payments will be accepted on the last 3 working days of every month.

2. Private-personal documents

2.1 Only original documents will be endorsed.

2.2 In case documents are not written into Spanish, an official translation into Spanish for reference must be provided. The translation into Spanish could also be included into the same document (i.e: a side by side translation, line by line translation or original text above and translation below).

2.3 The applicant must sign every page of the document (include signature + print name + ID/Passport number on every page).

2.4 The Notary Public who certifies the signature of the applicant must stamp his/her stamp and signature on every page of the document as well. At the front of the document, the Notary Public must add a Notarial Certicate (check a sample here) (*) with, at least, the following information: a) type and date of the document (e.g "Power of Attorney dated January 1, 2021") (**); b) full name and ID or passport number of the signatory. Behind the Notarial Certificate, the Notary Public must include, sign and stamp a copy of the ID or passport that the signatory used to identify him/herself before the Notary Public.

(*) There must be one (1) Notarial Certificate per document. If a Notarial Certificate legalizes more than one (1) document, then it will be rejected and not legalized by our Embassy.

2.6 Submission procedure: Please send us an email to arrange a date and time for submission (consular_emsia@mrecic.gov.ar).

2.7 Fees and payment: US$ 60 per document (to be paid in ringgits by online transfer). Upon submission, the Embassy will issue a receipt for payment to be made by online transfer to our associated bank. The transfer slip must be sent to the Embassy in order for us to process the documents. Kindly note that no payments will be accepted on the last 3 working days of every month.

This Embassy reserves all rights to reject any faulty document or documents which do not contain the necessary endorsements by the different parties.
